What we see happen is that one person stops making the payments and the second person does not know about it until it is too late and your credit is damaged.

&quot;Is there any way to be able to have the title changed after I pay off.. or even better .. is there any way to change the loan towards me..?&quot; - It is not clear from your post if the title or just the loan is under both of your names. If the title for the car is under both names she would have to transfer the title completely to you. However, you can not do this until the loan is paid in full and you have the title from the lender. If you can not pay off the loan you need to REFINANCE the existing loan. Basically this is equivalent to getting a new loan to pay off the existing loan. As part of this process you need to make sure that she is not on the title of the car you are going to keep.

Our advice is to refinance both loans if you can. And make sure that you are only responsible for your own actions. Unfortunately, divorce is one of the most common way to ruin your credit.

We as a family bought 2 cars.. but...

Car1: Is under her name
car2: is under both our names

The thing is that she asked for divorce and want to keep andmake the payments of the car that is under both our names.  And she wants me to keep paying Car 1 under her name.. Is there any way to be able to have the title changed after I pay off.. or even better .. is there any way to change the loan towards me..? I thought that the easy way is to have a loan to payoff theloan completely under her name and start paying under my name... is this a possibility???  thanks for any answer

Your situation is not simple. There are just too many variables at play to provide any concrete answers to you fundamental questions of “What I need to know is where I can get a car loan with an open ch 13? Do you have sources? More specifically, sources that won't gouge me 24%”. Each state has different laws and lenders have to be licensed in each state to provide the loans. As a result your location plays a big part in the type of loan you can and can not get as well as your interest rate. 

At the end of the day a lender needs to manage the risk and the only way to do this on a macro scale is to look at patterns. Unfortunately you fall into the ch 13 bucket and this will be a big red flag. And while it is clear that you are a “good person in a bad situation” the risk management formula will probably not put you into a low risk category (i.e. you will probably have a high interest rate).

Some good news, the fact that you have made your car loan payments on time is a big plus. Car Loan Lenders look at this very carefully and it does play an important part in the decision. 

Many Kia dealers have the ability to work with folks that have bad credit. Have you tried contacting your local Kia dealer(s)? With the current market conditions they just might be very happy to work with you.]]></description>

      <description><![CDATA[First, I am completely skeptical of &quot;bad credit&quot; loan places so making me feel comfortable is the first job.

My question revolves around finding an auto loan for those who are in an open chapter 13 situation.  Before our business failure I had absolutely perfect credit and several times just called the dealer, told them what I wanted and tomorrow I had it - delivered.  Then we had our tough times and closed the business.

I'm currently about 27 months into our five year ch 13 plan.  We had two car loans (taken out just before the ch 13 though Credit Acceptance after our previous leases were up) that we have paid off earlier this year, each with perfect records of on-time payments.  Our mortgage payments have been virtually perfect during our ch 13 time.  We have no other outstanding debts and our payments to the trustee have been perfect.
 
Our plan payments were negotiated to accommodate the car loans ending, then being replaced.  If not replaced our trustee payment would go up $300/mo which it did in July.  I mention that to say that the trustee, I'm told by my attorney, would almost certainly reduce our payment back to where it was.

What I need to know is where I can get a car loan with an open ch 13?  Do you have sources?  More specifically, sources that won't gouge me 24%.
 
Also, does down payment matter?  Currently, just $500 and a $1000 trade.  Come December, $1500-2000 and same trade.
 
Thoughts?

We are definitely one of those &quot;good people with bad circumstances&quot;.  I'm not looking for Cadillacs, I'm looking for something like a good-mileage new Kia.  My tastes aren't extravagant, never have been.  I just am trying to stop paying high mileage, used car repair bills every month.  It's already one or two car payments every month, I may as well be driving something better.

You are welcome to go to the Bob Watson dealer page on our site and leave a dealer review so others can benefit from your experience.

Unfortunately, as you are finding out it, is very difficult to get a car loan if you do not have a down payment. There are dealers and lenders that will consider it but we did not see any in your area.

If you really need a car we would recommend looking at your Tax Returns and/or your [url=http://www.irs.gov/irs/article/0,,id=177937,00.html]Economic Stimulus Payment[/url]. Many of our customers are using the stimulus check as a down payment for their car loan.

As with everyone in this economy I can afford the payment but the dwn payment is an other story. I went to Bob Watson and was treated so badly I cant believe this is how hard working people are treated. My wife and I dont have a great credit score mine is 514 and hers is 440. I went through a divorce 6 years ago and got hit hard. There really seems no way for us to purchase a car and all we need it for is me to go to work and her to run errands and be dependable and safe. We have tried everything and get more depressed at every turn. I want your help and advise.

This is a complicated question to answer because so many things depend on your location, your credit score, and the dealer/car you are interested in.

For the most part dealers do not want us to send them customers outside a reasonable distance from the store. Usually this distance is no more than 60 miles. Shipping a car is not cheap and since most of our customers struggle to come up with a down payment adding even more $ on top of the down payment is just not practical.

Your personal situation might be different and you very well might be able to cover the shipping costs as part of the deal. However, as a public site, our approach has to work for the overwhelming majority of the cases and for now we can't accommodate your request.

We do think that your need is not unique and we will continue to put together the most flexible solutions for our customers.

      <description><![CDATA[I second the idea of the home equity line of credit. The tax deduction definitely helps. It is always a good idea to explore ways to improve your credit. You can do things like challenge negative reportings on your credit file. If the source doesn't rebutt your challenge within a certain amount of time it will be taken off.

We did some research on this. Clearly we are not a legal expert so do take this at face value.

It appears that it is OK for a dealer to request a limited power of attorney.

From DMV site:
&quot;A general or &quot;limited&quot; power of attorney can be used to authorize another person to act on the grantor's behalf to complete, sign and/or pick-up motor vehicle title and/or tag documents. These powers of attorney cannot be used by the owner(s) to appoint the purchaser(s)/transferee(s) of their vehicle as their attorney-in-fact when the vehicle requires an odometer declaration on an acceptable secure document.&quot;

Even with a score in the low 400's you have options. You might be in the mid to upper 400's so your options might be better than I describe. In particular you might not have to pay a premium for the car and you should get a better interest rate.

Today many dealerships have the necessary financial relationships to get you into a car. Clearly you will not have the best interest rate (so be prepared for this). You will also probably end up paying a premium for the car (this helps the dealership and the lender lower their risk and exposure).
